Below is a list of states that have acted to allow remote notarization or remote witnessing on an emergency basis. This publication was compiled for the College by ACTEC Fellow Lauren Wolven of Chicago and her colleague, Erin Mayer. ALABAMA

Original Proclamation: only certain notaries may notarize signatures (attorney-notaries and notaries who work under the supervision of an attorney) and confirm witness signatures made in a videoconference. The date and time of the notarization is when the notary witnessed the signature during the videoconference even though the notary certifies and executes the documents afterwards.
Supplemental proclamation: A. Notaries appointed in AL (including non-attorney and unsupervised notaries) may notarize signatures remotely if they maintain a recording of the audio-video communication for 5 years after the recording is noted in the notary's logbook

Alternatively, there is an exception to the dual witness requirement in Probate Code section 6110(c)(2) that applies where “clear and convincing evidence” shows that, at the time the testator signed the will, he or she intended it to constitute his or her last will.

Notably, Montana Notaries are permitted to perform remote notarizations for signers outside the state.
COLORADO

State guidance: Many states around the country already permit notarizations to be performed remotely by trained online notaries who utilize regulated remote notary technology providers. There is currently nothing in Delaware statutes that prohibits an individual or business from using a remote notary from states who permit remote notarization.
The general public can use Notarize.com and NotaryCam or any other provider that they may research and choose. There are specific charges to remotely notarize a document using notaries who are licensed and trained to perform remote online notarizations.
FLORIDA

- Does state require will to be witnessed? No, to be a valid will, it need only be signed at the end. However, probate requires the affidavits (or testimony) of two witnesses. The requirement of two witnesses is satisfied by a self-proving will, which has the acknowledgement of the testator and affidavits of the two subscribing witnesses attached. If the will is not self-proving but was witnessed, affidavits of the subscribing witnesses can be taken by a notary. If the will was not witnessed or one or both of the subscribing witnesses are not available, affidavits of witnesses able to verify the testator’s signature can be taken by the register of wills. Holographic wills are valid if signed at the end, but have no special status and must be proved in the same way as other wills.(who need not be subscribing witnesses) in order to probate a will

The signer must be in Vermont. The notarial certificate must be hand-written, imprinted by a stamp or embosser, or both on the document. The Notary — or a person acting on their behalf — a must create an audio-visual recording of the notarization and retain it for at least 7 years.

Note from West Virginia Fellow: I can tell you that the Fellows in the state, myself included, do not think this Order is effective to waive our "notary in person" requirement as to the self-proving affidavit part of our statute based on the authority under that section and because of some very clear case law emanating from our state Supreme Court to the contrary.
Wills do not have to be notarized here to be valid; it is merely the self-proving affidavit part that would require notarization. Plus we recognize holographic wills.
