Beneficiaries, or those who thought they should have been beneficiaries, may believe they have grounds, and may be financially motivated, to challenge part or all of an estate plan. Several techniques and strategies may be considered, in designing the plan or implementing it, to dissuade or derail such a challenge. However, if used improperly or injudiciously, the effort could backfire badly. The panelists discussed and evaluated several of these techniques and strategies, including “no contest” provisions, arbitration clauses, medical exams, incorporation by reference and the closing of classes of beneficiaries.
