and Separate Property

Clients don’t stay put and don’t stay married (or single). The differences in marital property regimes complicate the estate planner’s work for these migrating clients whose marital status affects their estate plans. In this presentation, the panel discusses what we know and don’t know about the characterization of, creditor access to, and taxation of what was once community property or separate property as clients cross borders of community property states, common law states, and international jurisdictions.
